1. Introduction

Welcome to GlamConnect.in ("Service", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our cloud-based salon billing and WhatsApp CRM platform.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Definitions

  • "Account" means the unique account created for you to access our Service.
  • "Client Data" means any data, information, or material submitted by you or your customers through the Service.
  • "Subscription" means the paid plan you select to access the Service features.
  • "User" or "You" means the individual or business entity using the Service.

3. Account Registration

To use GlamConnect, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction
  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Be responsible for all activities that occur under your account
  • Immediately notify us of any unauthorized use of your account

4. Subscription and Payment

4.1 Free Trial

We offer a 14-day free trial for new users. No payment information is required during the trial period. At the end of the trial, your access will be limited unless you subscribe to a paid plan.

4.2 Paid Subscriptions

  • Subscriptions are billed monthly in advance
  • All prices are in Indian Rupees (INR) and exclusive of applicable taxes (GST)
  • Payment is due immediately upon subscription or renewal
  • We accept payments via UPI, credit/debit cards, and net banking
  • Failed payments may result in service suspension

4.3 Renewals and Cancellations

Your subscription will automatically renew each month unless you cancel before the renewal date. You may cancel your subscription at any time from your account dashboard. Cancellations take effect at the end of the current billing period.

5. Refund Policy

We offer a 7-day money-back guarantee for new subscribers. If you're not satisfied with the Service within the first 7 days of your initial paid subscription, contact us for a full refund. This applies only to first-time subscribers.

Refunds for subsequent billing periods are handled on a case-by-case basis. No refunds are provided for partial months or unused portions of the Service.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction (including copyright laws)
  • Transmit any viruses, malware, or harmful code
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to send spam or unsolicited messages
  • Impersonate any person or entity
  • Share your account credentials with others
  • Scrape, copy, or reverse engineer any part of the Service

7. WhatsApp Integration

Our WhatsApp messaging feature is subject to WhatsApp's Terms of Service and Meta's policies. You must:

  • Comply with all WhatsApp Business API policies
  • Obtain proper consent from customers before sending messages
  • Not use the Service for spam or unsolicited marketing
  • Respect opt-out requests from customers
  • Understand that WhatsApp may impose rate limits or restrictions

We are not responsible for any changes, suspensions, or terminations by WhatsApp/Meta that affect the messaging features.

8. Data Ownership and Usage

8.1 Your Data

You retain all rights to your Client Data. You are solely responsible for the accuracy, quality, and legality of your Client Data and the means by which you acquired it.

8.2 Our Rights

You grant us a limited license to use, store, and process your Client Data solely to provide and improve the Service. We may use aggregated, anonymized data for analytics and service improvement.

8.3 Data Backup

While we perform regular backups, you are responsible for maintaining your own backups of critical data. We recommend exporting your data regularly.

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by GlamConnect and is protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written permission. You may not copy, modify, distribute, sell, or lease any part of our Service.

10. Service Availability and Modifications

10.1 Uptime

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

10.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will make reasonable efforts to notify you of significant changes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLAMCONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim or ₹10,000, whichever is less.

12. Indemnification

You agree to indemnify and hold GlamConnect harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • You will have 30 days to export your Client Data
  • After 30 days, we may delete your data permanently
  • You remain liable for all charges incurred before termination

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

15. Dispute Resolution

In the event of any dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue legal remedies.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and GlamConnect regarding the Service and supersede all prior agreements and understandings.
